Declaration before 1 August 2021 - Apprenticeship Boost Initiative
This declaration applies to you if you're an employer who has applied for the Apprenticeship Boost Initiative for one or more apprentices before 1 August 2021.
By applying for Apprenticeship Boost, you (the employer) are declaring that for each apprentice named in your application, you:
- Meet the eligibility criteria for the Apprenticeship Boost Initiative, namely that:
- you employ an employee or engage a self-employed contractor who:
- is enrolled in a New Zealand Apprenticeship with a Transitional Industry Training Organisation (Transitional ITO); or
- is enrolled in a Managed Apprenticeship with a provider recognised by the Tertiary Education Commission (TEC); and
- is actively engaged in their programme of study; and
- is in paid employment or a paid contracting arrangement with you; and
- has completed no more than 24 months of a programme of study;
- you are not a State Sector employer, which means the following:
- Public Service
- Non-Public Service Departments
- Crown Entities
- Reserve Bank of New Zealand
- Offices of Parliament
- for each apprentice named in your application you are not also receiving a payment in respect of them under the following apprenticeship support schemes:
- Mana in Mahi under the Employment and Work Readiness Assistance Programme
- the COVID-19 Wage Subsidy and Extension
- the Flexi-Wage Subsidy
- the Regional Apprenticeships Initiative as administered by the Ministry of Business, Innovation and Employment (MBIE)
- any wage-subsidy component of the Māori Trades and Training Fund as administered by MBIE.
- you employ an employee or engage a self-employed contractor who:
- Agree that you will retain the apprentice.
- Agree that you are complying with your obligations under the Minimum Wage Act 1983.
- Agree that you will immediately notify the Ministry of Social Development (MSD) if there are any changes in circumstances for you or your apprentice that may affect your eligibility.
- Agree not to submit an invoice for the purposes of GST.
- Acknowledge that you will abide by the Code of Good Practice for New Zealand Apprenticeships.
- Agree that the apprentice has freely given their consent in writing to the information about them in your application being shared between you, MSD, TEC and MBIE, and has completed the relevant Apprentice Consent Form.
- Agree that all of the information you have provided to us is true, correct and complete, and to immediately contact us should it be necessary to correct any information provided to us at any time.
- Agree to repay any subsidy payments made to you if you:
- were not, or stop being entitled to the subsidy; or
- provide false or misleading information in your application, whether intentionally or otherwise.
- Acknowledge if you have provided false or misleading information you may be subject to an investigation including for offences under the Crimes Act 1961.
- Acknowledge that this declaration forms part of your application.
In submitting this declaration, you also acknowledge that:
- MSD collects the information in this application to determine whether you are eligible to receive assistance.
- You do not have to provide the information, but if you do not, we are likely to decline your application as we will not have enough information to determine whether you are eligible.
- Every apprentice named in your application is entitled to withdraw their consent for information about them to be included in your application. You acknowledge that if any apprentice does withdraw their consent, then you will not continue to include that apprentice in any subsequent or renewed application, unless and until any such apprentice decides to renew their consent.
- Under the Privacy Act 1993 you have the right to request access to all personal information held about yourself and to request corrections to that information. Your apprentices are also entitled to access and, where applicable, correct all personal information held by MSD, TEC and MBIE about themselves, that you have provided as part of this application.
By submitting this application, you also note that:
- MSD will use the information provided in this application to assess your eligibility to receive the Apprenticeship Boost Initiative. We may also use the information to contact you about matters relating to the assistance you applied for, or for reporting or research purposes.
- MSD will not use the information provided in this application for any other purpose or for assessing entitlement to any other assistance available from MSD unless required or authorised by law.
